Under the Indian Contract Act 1872, a verbal agreement can be legally binding if it meets the essential elements of a valid contract — offer, acceptance, consideration, and competency of parties. After filing, a trademark application is typically examined within 3–6 months. After examination and publication in the Trademark Journal, there is a four-month opposition window. If no opposition is filed, the mark is registered. The entire process typically takes 18–24 months. However, a TM symbol can be used from the date of application, providing some level of protection while the registration is pending.
